Rental Policy

We are Sea Play Homes LLC, doing business as Sea Play Homes ("Company," "we," "us," "our"), a company registered in Delaware, United States at PO Box 838, Bethany Beach, DE 19930.

We operate the websites https://seaplayhomes.com , https://seaplaylinens.com, and https://linens.seaplayhomes.com (individually the "Site", collectively the "Sites"), as well as any other related products and services that refer or link to these legal terms (the "Legal Terms") (collectively, the "Services").

Sea Play Homes offers linen rental services to short-term rental guests and property owners.

These Rental Policy constitutes a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Sea Play Homes LLC, concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

PRODUCT AVAILABILITY

  • To ensure product availability we strongly recommend submitting rental orders at least 14 days prior to your stay.

  • All orders are subject to availability.

  • Product style, color, and/or pattern may be subject to change without prior notice.

  • Sea Play Homes does its best to ensure product description accuracy. We are not responsible for errors in product descriptions.

ORDERS

  • Please check your order confirmation email for accuracy. Be sure to verify the delivery address along with check-in and check-out dates are accurate. 

  • When placing orders please be sure to include a unit number (if applicable) and any door/gate codes (including lobby door).

  • If possible, please provide contact information for your host and/or rental agency.

  • We do NOT confirm order information with property owners or managers.

  • If we are unable to deliver an order due to an error in the information you provided, or because we are unable to access the property, there will be a $25 re-delivery fee required prior to re-delivery.

  • Please notify us immediately of any errors or changes to your order.

  • Orders placed less than 48 hours from day of check-in are subject to a $50 rush order fee. Please select RUSH DELIVERY as your delivery option at checkout.

  • Unused linens are not eligible for a refund.

DELIVERY/PICKUPS

  • We charge a flat rate delivery/pickup fee of $25 on all orders.

  • For orders placed within 48 hours of arrival the delivery/pickup fee is $50.

  • All deliveries are made between 9:30am and 8:00pm on the day of your check-in. 

  • We are unable to schedule or guarantee a specific delivery time.

  • You do NOT need to be present at time of delivery or pickup.

  • If you are renting in a condo building or gated community please make sure we have a lobby and/or gate access code. 

  • We do our best to have all deliveries completed by 8:00pm, however, due to traffic, weather, local events, and/or volume we may have delays. We appreciate your understanding. There are NO REFUNDS for delayed deliveries.

  • FOR PICKUP:

    • You do NOT need to launder any sheets or towels.

    • All linens must be stripped from beds and all towels gathered from bathrooms and placed in back in the bags they were delivered in.

    • Please leave all linens in the location they were dropped off no later than 9:30am on the day of your checkout. If we are unable to retrieve linens you may be subject to a return trip fee of $50 or the full replacement of linens.

    • If you are staying in a condo or building that does not allow linens to be placed in hallways, please ensure we have access to the unit you are staying in and leave all linens inside front door.

DAMAGES

  • Any items that are stained, torn, ripped, frayed, or otherwise damaged upon delivery must be reported within 24 hours. Failure to report a damaged item may result in additional charges and/or forfeiture of security deposit.

  • You are solely responsible for any damage or theft of any item you have rented and will be billed accordingly.

PAYMENTS

  • Sea Play Homes gladly accepts all major credit & debit cards (Visa, MasterCard, Discover, American Express).

  • Payment is due in full at time of rental reservation.

CANCELLATIONS

  • Cancellations placed at least 14 days prior to your scheduled check-in date will receive a full refund.

  • Cancellations placed 7-14 days prior to your scheduled check-in date will receive a 75% refund.

  • Cancellations placed 3-7 days prior to your scheduled check-in date will receive a 50% refund.

  • Cancellations received less than 3 days prior to your scheduled check-in date will not receive a refund.

  • No refunds will be processed for inclement weather or voluntary evacuations.

  • If a mandatory evacuation is ordered during your stay, we will refund you 75% of your order. 

SATISFACTION GUARANTEE

  • Sea Play Homes takes great pride in providing the best quality linens and beach rentals along with exemplary customer service.

  • Our team is available 24x7 to answer any questions regarding your order.

  • You agree to inspect all items upon arrival for any missing or damaged items. If anything is damaged please contact us within 24 hours of your check-in date for a replacement. 

  • Sea Play Homes reserves the right to hold you liable for the full replacement cost of any missing or damaged items not reported within the first 24 hours.

  • No refunds will be issued for missing or damaged items. 

TERMS & CONDITIONS

  • These Terms & Conditions form a sole agreement between the Lessee (or "Customer") and Sea Play Homes, LLC (the "Company" or "Lessor").

  • Lessor hereby leases to the Lessee, and Lessee hereby leases from the Lessor tangible property (the "Equipment"), including Bed Linens, Bath Towels, Hand Towels, Bath Mats, Washcloths, Kitchen Towels, Pillows, Pillowcases, Blankets, Comforters, Mattress Pads, Cribs, Pack-N-Plays, and any other tangible property the Lessor may lease from time to time.

  • The lessee acknowledges that he/she will personally inspect the Equipment, find them suitable for his/her needs and in good condition, also he/she understands the proper use and agrees to inspect the Equipment prior to use and notify Lessor of any defects or incorrect Equipment within 24 hours of receipt of the Equipment.

  • All Equipment is used at Lessee's risk.

  • Lessor does not guarantee or accept responsibility for any Equipment that does not fit properly. It is up to the Lessee to verify that such Equipment is suitable for Lessee’s needs prior to delivery.

  • The Lessee assumes all responsibility for Equipment while in Lessee's possession.

  • Use of Equipment in the following circumstances is prohibited and constitutes a breach of contract: (a) Improper, and unintended use or misuse. (b) Use by anyone other than Lessee. (c) Use at any location other than the address furnished by the Lessee

  • The Lessee shall be liable for any loss, theft, damage or destruction of rented equipment.

  • The Lessee understands that there exist certain risks of injury from the use or misuse of such items, including the potential risk of serious injury, disability or death from the use of such items.

  • The Lessee agrees to indemnify and hold Lessor and its officers, employees, shareholders and agents harmless for any claims from Lessee's use or misuse, including any third parties for loss, injury and damage to persons or property arising out of the renters negligence or operation, including any legal costs incurred in the defense of such claims.

  • Lessee agrees to pay Lessor for any lost, stolen, and/or damaged rental items during the rental period.

  • All lost, stolen, and/or damaged items will be paid for by the Lessee at the current retail price determined by Lessor.

  • Accrued rental charges and/or security deposits cannot be applied against the purchase price of damaged or lost items.

  • Lessee agrees that no refunds will be given for delayed deliveries.

  • Lessee acknowledges they have read, understand, and accept Lessor's Cancellation Policy as stated above.

  • LESSOR DISCLAIMS ALL WARRANTIES IN CONNECTION WITH THE EQUIPMENT, EXPRESS OR IMPLIED, AS TO ANY MATTER WHATSOEVER, INCLUDING WITHOUT LIMITATION DESCRIPTION, QUALITY, DESIGN, PERFORMANCE, SPECIFICATIONS, CONDITION, MERCHANTABILITY, AND FITNESS FOR ANY PARTICULAR PURPOSE, EXCEPT AS EXPRESSLY SET FORTH IN THIS CONTRACT. Lessor further disclaims any liability for loss, damage, or injury to Lessee or third parties as a result of any defects, latent or otherwise, in the equipment whether arising from Lessor’s negligence or application of the laws of strict liability. The Equipment covered this contract have been leased by Lessee AS IS and WITH ALL FAULTS, and Lessee acknowledges that no warranties of merchantability or fitness for any particular purpose are to be implied in this transaction. If the Equipment becomes unsafe or in disrepair during the term of this Lease, Lessee agrees to discontinue use and to notify Lessor immediately. Lessor will then attempt to replace the Equipment with similar Equipment within a reasonable time, if similar Equipment is available at the time Lessor receives notice of said condition.

  • Neither party will be liable in damages or have the right to terminate this Agreement for any delay or default in performing hereunder if such delay or default is caused by conditions beyond its control including, but not limited to, acts of God (such as natural disasters), government restrictions (including the denial or cancellation of any export or other necessary license), wars, insurrections, or any other cause beyond the reasonable control of the party whose performance is affected. Should Lessee’s event be cancelled, postponed or otherwise adversely impacted as a result of a force majeure event, there will be no refunds for payments already received by Lessor, but Lessor will use all reasonable efforts to work with Lessee to provide the Rental Items at a later date if necessary, subject to the availability of the Rental Items and Lessor’s delivery/set-up representatives.

  • The Equipment is, and at all times shall remain, the sole and exclusive property of Lessor; and the Lessee shall have no right, title, or interest therein or thereto except as set forth in this Lease. Lessee has no right to purchase or otherwise acquire title to or ownership of any of the Equipment or property of this Lease no matter that the Equipment or any part thereof may now be, or hereafter become, attached or affixed to real property or any improvements thereon.

  • By making payment for any and all rental charges the Lessee agrees that they acknowledge and accept the Lessor's policies and these Terms and Conditions.
